Welcome to Altaform! The terms "we", "us", and "our" refer to Altaform. Altaform operates this store and website (altaform.co), including all related information, content, features, tools, custom fabrication services, and products to provide you with a curated shopping experience (the "Services"). Altaform is hosted on Shopify, which provides the e-commerce platform that enables us to sell our products and Services to you.

The terms and conditions below, together with any referenced policies (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

By visiting, browsing, submitting files, approving digital previews, or purchasing from our store, you agree to be bound by these Terms of Service, our Privacy Policy, and our Refund and Return Policy. SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state, province, or country of residence.

To complete purchases, you may be asked to provide certain information, including your email address, billing, payment, and shipping details. You represent and warrant that all information you provide is accurate, current, and complete. You are solely responsible for maintaining the security of any account credentials and for all activities that occur under your account.

SECTION 2 - PRODUCTS & THE NATURE OF 3D PRINTING

We make every effort to display the colors, textures, and details of our products accurately. However, colors and material finishes may vary slightly depending on monitor configurations and ambient lighting.

  • Additive Manufacturing: Our displays and artifacts are individually custom-made using precision 3D printing (additive manufacturing). Minor surface layer lines, slight seam variations, micro-textures, and subtle sheen differences are inherent to the 3D printing process and raw material batches. You acknowledge that these variations are natural characteristics of physical additive manufacturing and do not constitute manufacturing defects.

  • All product descriptions, specifications, and availability are subject to change at any time without notice at our sole discretion. We reserve the right to limit the sales of our products to any person, geographic region, or jurisdiction on a case-by-case basis.

SECTION 3 - CUSTOM ORDERS, DESIGN APPROVAL & USER SUBMISSIONS

  • Made-to-Order & Final Sale: All Altaform products are individually manufactured to order based on custom route data, athletic milestones, and personalized parameters. Once an order is accepted and digital proof approval is provided, production begins, and the sale is deemed final in accordance with our Refund and Return Policy.

  • Digital Proof Approval: Before manufacturing, we provide a digital design proof for your review. You are solely responsible for verifying all details, including route geometry, event names, spelling, athlete names, dates, split times, and layout aesthetics. Once you confirm and approve the proof, you waive the right to request modifications, cancellations, or refunds based on typographical errors, submitted data mistakes, or layout preferences.

  • Customer Submitted Content & Third-Party Marks: By submitting route data (GPX/FIT files), graphics, race event details, or photos, you represent and warrant that you own or have the legal right/license to use and submit such content. You agree that Altaform is not responsible or liable for any third-party trademark, race brand, copyright, or intellectual property claims arising from the custom materials or text you instruct us to incorporate into your piece.

SECTION 4 - ORDERS AND CANCELLATIONS

When you place an order, you are making an offer to purchase. Altaform reserves the right to accept or decline your order for any legitimate reason at its discretion (including suspected fraud, inability to process payment, or technical feasibility of the submitted route).

Your order is not confirmed until payment has been successfully processed. Because our production pipeline begins promptly following design approval, cancellation requests cannot be accommodated once manufacturing has commenced.

SECTION 5 - PRICES, TAXES, AND BILLING

Prices, promotions, and discounts are subject to change without notice. The price charged will be the price in effect when the order is placed, as confirmed in your order confirmation email.

Unless expressly stated at checkout, posted prices do not include shipping, handling, international customs duties, import tariffs, or local VAT/sales taxes applicable in your destination country. All import fees, duties, and customs clearances are the sole responsibility of the customer.

You agree to provide current, complete, and accurate billing and payment information. You represent and warrant that you are authorized to use the designated payment method and that all charges will be honored by your issuing provider.

SECTION 6 - SHIPPING, DELIVERY & RISK OF LOSS

Shipping and delivery estimates provided at checkout or via email are estimates only and are not guaranteed. We are not liable for shipping delays caused by couriers, severe weather, natural events, international customs clearance, or postal strikes.

Title and risk of loss pass to you once the package is handed over to the shipping carrier. Damaged shipments or items lost in transit must be reported strictly in accordance with our Refund and Return Policy within 5 calendar days of recorded delivery, accompanied by required photographic documentation of the outer packaging and labels.

SECTION 7 - INTELLECTUAL PROPERTY

The Services and all original content—including website design, 3D digital model architecture, branding, graphics, text, product photography, software code, and marketing assets—are the exclusive property of Altaform.

You may use the Services solely for your personal, non-commercial use. You may not copy, reverse engineer, extract 3D mesh geometry, reproduce, distribute, or create derivative works from our physical designs, digital terrain layouts, or digital assets without prior written consent from Altaform.

SECTION 8 - THIRD-PARTY TOOLS AND LINKS

We may provide access to optional third-party tools, tracking portals, or mapping integrations over which we have no control. Such tools are provided "as is" and "as available" without warranties of any kind.

Our website may also contain links to external third-party sites or services. We are not responsible for the content, accuracy, policies, or actions of third-party platforms. Any engagement with third-party tools or sites is conducted entirely at your own risk.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Altaform is hosted on the Shopify platform. However, all commercial transactions, customer service agreements, and product sales are made directly between you and Altaform.

Shopify is an independent platform provider and is not responsible or liable for any aspect of the transactions, products, manufacturing, delivery, or warranties provided by Altaform.

SECTION 10 - PRIVACY AND DATA PROCESSING

Your submission of personal information through the store is governed by our Privacy Policy. Because our storefront is powered by Shopify, certain personal and transaction data is collected, processed, and stored by Shopify in compliance with applicable data protection regulations. SECTION 11 - CUSTOMER FEEDBACK AND REVIEWS

If you submit reviews, testimonials, photos of your received display, comments, or suggestions ("Feedback"), you grant Altaform a non-exclusive, perpetual, worldwide, royalty-free license to use, display, publish, and distribute that Feedback on our website, social channels, and promotional materials.

You warrant that your Feedback does not infringe on third-party intellectual property or privacy rights and does not contain abusive, defamatory, or unlawful content.

SECTION 12 - PROHIBITED USES

You agree not to use the Services or our products:

  • For any unlawful, fraudulent, or malicious purpose;

  • To infringe upon our intellectual property rights or the rights of third parties;

  • To submit copyrighted race course brands, logos, or defamatory text without proper authorization;

  • To reverse engineer, scrape, extract 3D printing geometries, or harvest data through bots, scrapers, or unauthorized AI agents;

  • To interfere with or circumvent the security mechanisms or integrity of the website.

Violation of these prohibitions may result in immediate cancellation of your order and termination of access to our Services.

SECTION 13 - DISCLAIMER OF WARRANTIES

EXCEPT AS EXPRESSLY STATED BY ALTAFORM, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE OPERATION OF THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE, NOR THAT OUR PRODUCTS WILL MEET INDIVIDUAL SUBJECTIVE EXPECTATIONS BEYOND THE VERIFIED PHYSICAL SPECIFICATIONS APPROVED IN THE DIGITAL PROOF.

SECTION 14 - LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ALTAFORM, ITS FOUNDERS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, REPLACEMENT COSTS, OR SIMILAR DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PROCURED THROUGH ALTAFORM.

IN ALL CIRCUMSTANCES, ALTAFORM’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO ANY TRANSACTION SHALL NOT EXCEED THE PURCHASE PRICE PAID BY YOU FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

SECTION 15 - INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Altaform and our affiliates, partners, officers, employees, and service providers from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law, or your submission of materials/data that infringes upon third-party rights.

SECTION 16 - SEVERABILITY & ENTIRE AGREEMENT

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall remain enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed without affecting the validity of the remaining provisions.

These Terms of Service, along with our Privacy Policy and Refund and Return Policy, constitute the entire agreement between you and Altaform regarding your purchase and use of the Services, superseding any prior communications or proposals.

SECTION 17 - GOVERNING LAW AND JURISDICTION

These Terms of Service and any purchase agreements shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You and Altaform irrevocably consent to the exclusive jurisdiction and venue of the courts located in Toronto, Ontario, Canada for the resolution of any disputes.
